
Any longtime reader of Binge Gamer (or anyone who googles “Bobby Kotick“) knows how I feel about Activision. However, when it comes to their recent legal spat with former relevant musical act No Doubt, I have been nothing but supportive of Activision. In fact, if Activision could somehow buy the rights to the entire No Doubt collection and rid the Earth of their incessantly god fucking awful music (and take “Bush” with them?), I would build a shrine to Bobby Kotick.
So you can imagine my unbridled joy when it was revealed that Activision is countersuing the band, alleging breach of contract as well as unjust enrichment.
The countersuit comes in direct response to No Doubt’s lawsuit against Activision, which basically claimed that they weren’t happy with how they were portrayed in Band Hero. To that end, Activision explained the circumstances behind the band’s faux-outrage:
Activision admits that although it is possible to program a videogame whereby particular in-game characters can only be selected when certain songs are played, Plaintiff first requested this only after the “Band Hero” programming was finalized, had been submitted to all of the U.S. console manufacturers for approval and had been approved for manufacture by most console manufacturers…
In short: The game was already in the process of being shipped before the band decided to speak up.
While the majority of the accusations being made by Activision seem rather forward and blunt, there has been some confusion regarding the charges of “unjust enrichment”. Most likely this has to do with some kind of advertising campaign that was to center around No Doubt that was scrapped when the legal waters became choppy.
You know, because the band were indecisive nitwits who decided to throw a hissy fit.
